  The following conditions apply unless they have been superseded by provisions of the Licensing Act 2003.

   

   

  Off Licence Conditions

   

  Embedded conditions

   

  Alcohol shall not be sold or supplied except during permitted hours. In this condition, permitted hours means:

   

  a. On weekdays, other than Christmas Day, 8 a.m. to 11 p.m.

  b. On Sundays, other than Christmas Day, 10 a.m. to 10.30 p.m.

  c.  On Christmas Day, 12 noon to 3 p.m. and 7 p.m. to 10.30 p.m.

  d. On Good Friday, 8 a.m. to 10.30 p.m.

   

  The above restrictions do not prohibit:

   

  (a) during the first twenty minutes after the above hours, the taking of the alcohol from the premises, unless the alcohol is supplied or taken in an open vessel;

  (b) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;

  (c) the sale of alcohol to a trader or club for the purposes of the trade or club;

  (d) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;

   

   

  Licensing Act 2003 Mandatory Conditions

   

  Mandatory conditions where licence authorises the supply of alcohol

   

   

  (1)              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

• ANNEX 2 - Conditions Consistent with the operating schedule

   

  1) CCTV installed and fully operational.

  2) No smoking policy on the premises.

  3) Clear signs indicating all exits and fire extinguishers.

  4) All exits to be maintained and free from obstruction at all times.

  5) Fire doors to be kept closed.

  6) Exit doors to be kept unlocked during trading hours.

  7) Signs to be displayed for customers clearly identifying slippery surfaces.

  8) A well - maintained first aid kit will always be kept on the premises and details of any accidents or fires will be logged and kept on record.

  9) Litter bin(s) provided within the premises for use by customers.

  10) Litter originating from the business outside the premises will be collected and disposed of at the end of the day.

  11) Prominent, clear and legible notices to be displayed requesting the public to respect the needs of local residents and to leave the premises and area quietly.

  12) All the alcohol is to be kept behind Security Screens.

  13) Proof of age scheme in operation for under 21's.

  14) Records of refusal are kept and warning signs are also displayed.

   

   

   

   

   

   

• ANNEX 3 - Conditions attached after a hearing by the licensing authority

   

  1) The shop will close at 23.30hrs, no further sale taking place from the front of the shop after these hours.

  2) Deliveries will take place from the rear of the premises during the hours after 23.30 hrs and before 04.00 hrs.

  3) All delivery drivers will hold the National Qualification for Personal Licence Holders.

  4) The operating Schedule will be maintained at point of delivery, ie anyone who appears to be under 21 should be asked to provide ID.

  5) A log of all deliveries including alcohol shall be maintained.

  6) The existing CCTV system to be maintained, and all video footage retained for 28 days.

  7) CCTV video images to be made available, on demand, to the police.

  8) The premises will be closed at 4.00am.

  9) No alcohol is to be delivered without a food order placed from the applicants adjoining premises.
