  The following conditions apply unless they have been superseded by provisions of the Licensing Act 2003.

   

  Club premises certificate Conditions

   

  Embedded Conditions

   

  Alcohol shall not be sold or supplied except during permitted hours.

  In this condition, permitted hours means:

  a. On weekdays, other than Christmas Day, Good Friday or New Year’s Eve, 11 a.m. to 11 p.m.

  b. On Sundays, other than Christmas Day or New Year’s Eve, 12 noon to 10.30 p.m.

  c. On Good Friday, 12 noon to 10.30 p.m.

  d. On New Year’s Eve, except on a Sunday, 11 a.m. to 11 p.m.

  e. On New Year’s Eve on a Sunday, 12 noon to 10.30 p.m.

  f. On Christmas day, as provided by the rules of the club and notified in writing by the chairman or secretary of the club to the chief executive of the justices for the petty sessions area in which the premises are. The said hours shall:

  i.  not exceed six and a half hours;

  ii. not begin earlier than 12 noon;

  iii. not end later than 10.30 p.m.

  iv. provide for a break of at least 2 hours, including 3 p.m. to 5 p.m.;

  v. not extend for more than three and a half hours after 5 p.m.

  The above restrictions do not prohibit the supply to, or consumption by, any person of alcohol in any premises where they are residing.

  g. On New Year’s Eve from the end of permitted hours to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31st December).

   

  Credit Sales

  Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied:

  (a) with and for consumption at a meal supplied at the same time, consumed with the meal and paid for together with the meal;

   

  Certificate authorising supply of alcohol for consumption off the premises
   

  (1) A club premises certificate may not authorise the supply of alcohol for consumption off the premises unless it also authorises the supply of alcohol to a member of the club for consumption on those premises.
   

  (2) A club premises certificate which authorises the supply of alcohol for consumption off the premises must include the following conditions.
   

  (3) The first condition is that the supply must be made at a time when the premises are open for the purposes of supplying alcohol, in accordance with the club premises certificate, to members of the club for consumption on the premises.
   

  (4) The second condition is that any alcohol supplied for consumption off the premises must be in a sealed container.
   

        (5) The third condition is that any supply of alcohol for consumption off the

              premises must be made to a member of the club in person.

   

   

  Licensing Act 2003 Mandatory Conditions

   

  Mandatory conditions where licence authorises the supply of alcohol

   

   

  (1)              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

   

   

  Mandatory Condition where the licence permits the performance of Films

   

  Where a programme includes a film in the 12A, 15 or 18 category, as classified by the British board of Film Classification, no person appearing to be under the age of 12 (and unaccompanied in that case),15 or 18 as appropriate shall be admitted to any part of the programme; and the licence holder shall display in a conspicuous position a notice in the following terms-

   

  PERSONS UNDER THE AGE OF [INSERT APPROPRIATE AGE] CANNOT BE ADMITTED TO ANY PART OF THE PROGRAMME

   

  Where films of different categories form part of the same programme, the notice shall refer to the oldest age restriction.

   

  This condition does not apply to members of staff under the relevant age while on duty provided the prior written consent of the person’s parents or legal guardian has first been obtained.

   

  Immediately before each exhibition of a film passed by the British Board of Film Classification there shall be exhibited on screen for at least five seconds a in such a manner that it can be easily read by all persons in the auditorium a reproduction of the certificate of the Board or, as regards a trailer advertising a film, of the statement approved by the Board indicating the category of the film

   

  Mandatory conditions where Door Supervisors are provided

   

  All individuals who carry out security activities must be licensed by the Security Industry Authority (SIA)

   

  Mandatory Conditions for club Premises with off sales

   

  1) The supply of alcohol for consumption off the club premises must be made at a time when the premises are open for the purposes of supplying alcohol, in accordance with the club premises certificate, to members of the club for consumption on the premises.

   

  2) Any alcohol supplied for consumption off the premises must be in a sealed container.

   

  3) That any supply of alcohol for consumption off the premises must be made to a member of the club in person.

   

   

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  1. Exterior lighting.

  2. Club constitution, rules and code of conduct in place.

  3. Admission to premises restricted to club members and bona fide guests.

  4. All guests are signed in by host member.

  5. Any misconduct by patrons will be reported to the club committee.

  6. Fully compliant with health and safety regulations.

  7. Fully compliant with fire precaution regulations.

  8. Preventative and control measures in place to ensure the safety of members and guests.

  9. Fire action notices are clearly and prominently displayed.

  10. Emergency escape routes are signposted.

  11. Notice(s) displayed near to point of egress requesting patrons to leave quietly.

  12. When live or recorded music is played, all reasonable steps are taken to avoid disturbance to neighbouring properties.

  13. Any person under the age of 18 years are only permitted into the premises if accompanied by an adult member.

  14. Committee members, stewardess and bar staff are instructed in the offence provisions of the Licensing Act 2003.

  15. Private parties are permitted, in the function room, only with prior approval and authorisation of the committee.

  16. The premises will close no later than one hour after the terminal hour for the supply of alcohol (as specified within section 'L' of the club premises application.

  17. No person under the age of 18 years will be permitted to use ant AWP / Gaming machine.

  18. Any AWP / Gaming machines installed on the premises must have a current licence / permit in force.

  19. Any AWP / Gaming machines must be clearly visible from the bar servery area.

  20. There shall be no entertainment of an adult nature.
