ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. Any staff employed at the premises to receive training by the Designated Premises Supervisor on first appointment and at least every six months thereafter. Training to include input on preventing underage sales, sales of alcohol to people who are drunk, application of the drugs policy and any other relevant matters. A written record to be kept of all training carried out. This record must be kept on the premises and made available for inspection by any responsible authority.
2. The Designated Premises Supervisor to maintain a written record of all members of staff who are authorised to sell alcohol.
3. The premises to operate with a ‘Due Diligence’ Folder. The folder will be retained at the premise and be made available at all times for inspection.
The Due Diligence Folder to contain the following documentation
• Licensing health Check
• 3 monthly checklist
• Independent auditors 3 monthly inspection report
• The 4 Licensing objectives (explained)
• DPS Contact details
• DPS Authorisation to sell alcohol
• Age Verification policy (challenge 25)
• Drugs policy
• Purchasing Policy
• Litter policy and record of checks
• Incident log paginated
• CCTV equipment weekly check report
• Refusals register
• Staff training portfolios.
• Noise Management Policy
4. The premises to undertake a 6 monthly Due Diligence monitoring . Each check to be recorded in the Due Diligence Folder and certify compliance of the premises licence conditions or record non-compliance and action taken to remedy non compliance
5. The premises Licence Holder and designated premises Supervisor to comply at all times with any requirement of the Licensing Authority and Police including the implementation of any remedial actions required at the direction of the Licensing Authority and Greater Manchester Police.
6. Digital CCTV system installed.
7. CCTV system produces images of evidential quality.
8. CCTV system operates in all lighting conditions.
9. CCTV system captures images of all entrances and exits and all areas the public have legitimate access too. Including all outside areas.
10. CCTV system maintained in good working order at all times.
11. CCTV system shows correct time(s) and date(s).
12. CCTV system checked daily prior to any sale or supply of alcohol taking place.
13. Written record of CCTV system checks maintained.
14. If CCTV system is not working then no sale or supply of alcohol shall take place until the system is functioning properly.
15. CCTV images retained for a minimum of 31 consecutive days.
16. ALL CCTV images made available for viewing or copies made at the request of the Police of other relevant Authority, including the Rochdale Council Licensing Service.
17. CCTV equipment retained in a secure environment.
18. Staff members capable of operating CCTV system available at all times.
19. CCTV operates at all times premises open to members of the public
20. CCTV system installed so as to ensure all public areas are covered.
21. Pre- booked functions: 2 x SIA licensed door supervisors deployed from 19:00hrs to 15 minutes after the premises close.
22. Pre-booked day time functions: The DPS will conduct dynamic risk assessments prior to agreeing any daytime functions and will assess any need for SIA door supervision in advance of those events taking place. If those events are expected to or actually do continue beyond 19:00hrs then condition 21 (Above) will apply.
23. Log of SIA start times, finish times, SIA licence numbers maintained on site and made available for inspection to the Police / Licensing Authority upon re-quest.
Drugs:
24. Clear Notice displayed at ALL Entrances to the premises stating that the Club Operates a strict anti- drug policy. Any person found to be using drugs at or adjacent to the premises will be permanently excluded from the premises.
25. Written Drug Policy in place.
26. Report any person found to be in possession of drugs immediately to GMP.
27. Confiscated drugs are held in a secure location on the premises.
28. Arrangements made to contact GMP for the collection and destruction of any drugs found.
29. Any person found to be in possession of drugs will receive an immediate life time ban from the premises.
Incident Book
30. An incident book (with the pages numbered sequentially) kept on the premises and in the delivery vehicles and be made available for inspection by responsible authorities. The incident books used to record the following:
(i) Any incident of violence or disorder on or immediately outside the premises
(ii) Any incident involving controlled drugs (supply/possession/influence) on the premises
(iii) Any other crime or criminal activity on the premises
(iv) Any refusal to serve alcohol to persons who are drunk (On sale and off sale premises only)
(v) Any refusal to serve alcohol to under 18’s or anyone who appears to be under 18
(vi) Any call for police assistance to the premises
(vii) Any ejection from the premises
(viii) Any first aid/other care given to a customer
Interior Layout.
31. The interior of the premises will be set out to ensure public safety.
32. The premises will operate a glass collection policy and staff trained to implement it
33. A noise management policy will be in place and contained in the due diligence folder and made available on request. Copy of NMP as attached.
34. Notices asking customers to respect our neighbours and keep noise to a minimum will be displayed at all entrances and exits and various locations around premises. Including any areas used for smoking.
35. Smoking areas will be contained as far away from neighbouring residential properties as possible (if applicable).
36. If door staff are on duty it will be part of their role to ensure that any noise is kept to an acceptable level. If no door staff it will be the responsibility of the duty manager.
37. After 21:00 the outside area is only to be used for smoking in designated areas
38. No drinks allowed outside after 21:00
39. No person under the age of 18 permitted on the premises at any time the premises are open, unless accompanied by a responsible adult over the age of 18.
40. Challenge 25 Policy in place.
41. Challenge 25 posters clearly and prominently displayed in main bar areas and entrance.
42. Staff trained in regard to Licensing legislation and responsibilities under Challenge 25 Policies.
43. A record of training is maintained and produced upon request to authorised Officers of the Local / Licensing Authority.
44. Refusals log maintained.
45. Refusal log produced on request to Police / Licensing Authority.
