  Licensing Act 2003 Mandatory Conditions

   

   

  Mandatory Condition where the licence permits the performance of Films

   

  Where a programme includes a film in the 12A, 15 or 18 category, as classified by the British board of Film Classification, no person appearing to be under the age of 12 (and unaccompanied in that case),15 or 18 as appropriate shall be admitted to any part of the programme; and the licence holder shall display in a conspicuous position a notice in the following terms-

   

  PERSONS UNDER THE AGE OF [INSERT APPROPRIATE AGE] CANNOT BE ADMITTED TO ANY PART OF THE PROGRAMME

   

  Where films of different categories form part of the same programme, the notice shall refer to the oldest age restriction.

   

  This condition does not apply to members of staff under the relevant age while on duty provided the prior written consent of the person’s parents or legal guardian has first been obtained.

   

  Immediately before each exhibition of a film passed by the British Board of Film Classification there shall be exhibited on screen for at least five seconds a in such a manner that it can be easily read by all persons in the auditorium a reproduction of the certificate of the Board or, as regards a trailer advertising a film, of the statement approved by the Board indicating the category of the film

   

   

   

   

   

   

   

   

   

   

   

   

   

• ANNEX 2 - Conditions Consistent with the operating schedule

   

  1) During all opening times, site management control entry and patrol the premises.

   

  2) Perimeter fencing covered by CCTV system which is fully operational.

   

  3) Abide by regulations set by Rochdale MBC LEA.

   

  4) Corporate Health & Safety policy in place.

   

  5) Facility risk assements carried out with public liability insurance in place.

   

  6) Constant supervision of children for protection from harm.

   

  7) Child protection policy in place.

   

   

   

   

   

• ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY

   

  1) "Any persons or organisations wishing to use the facility, (premises/land) for an event , will be required to provide risk assessments and proof of Public Liability insurance at least 28 days prior to any event taking place to the holder of the premises licence.

   

  The premises licence holder will notify each of the responsible authorities (for whom the original application was served upon) of any intended event at least 28 days prior to the proposed commencement date of that event.  The premises licence holder will provide a copy of the risk assessment and valid insurance documents to each of the responsible authorities at least 28 days prior to the proposed date of the event .  The premises licence holder will comply with any request from a responsible authority to implement actions/procedures in relation to the event as prescribed by the relevant responsible authority prior to the event taking place."

   

  2) Full Public Liability Insurance for all booked and owned event activities and individual parties provide their own insurance which must be in place.

   

  3) The site is fully fire and risk assessed
