  The following conditions apply unless they have been superseded by provisions of the Licensing Act 2003.

   

  Club premises certificate Conditions

   

  Embedded Conditions

   

  Alcohol shall not be sold or supplied except during permitted hours.

  In this condition, permitted hours means:

  a. On weekdays, other than Christmas Day, Good Friday or New Year’s Eve, 11 a.m. to 11 p.m.

  b. On Sundays, other than Christmas Day or New Year’s Eve, 12 noon to 10.30 p.m.

  c. On Good Friday, 12 noon to 10.30 p.m.

  d. On New Year’s Eve, except on a Sunday, 11 a.m. to 11 p.m.

  e. On New Year’s Eve on a Sunday, 12 noon to 10.30 p.m.

  f. On Christmas day, as provided by the rules of the club and notified in writing by the chairman or secretary of the club to the chief executive of the justices for the petty sessions area in which the premises are. The said hours shall:

  i.  not exceed six and a half hours;

  ii. not begin earlier than 12 noon;

  iii. not end later than 10.30 p.m.

  iv. provide for a break of at least 2 hours, including 3 p.m. to 5 p.m.;

  v. not extend for more than three and a half hours after 5 p.m.

  The above restrictions do not prohibit the supply to, or consumption by, any person of alcohol in any premises where they are residing.

  g. On New Year’s Eve from the end of permitted hours to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31st December).

   

  Credit Sales

  Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied:

  (a) with and for consumption at a meal supplied at the same time, consumed with the meal and paid for together with the meal;

   

  Certificate authorising supply of alcohol for consumption off the premises
   

  (1) A club premises certificate may not authorise the supply of alcohol for consumption off the premises unless it also authorises the supply of alcohol to a member of the club for consumption on those premises.
   

  (2) A club premises certificate which authorises the supply of alcohol for consumption off the premises must include the following conditions.
   

  (3) The first condition is that the supply must be made at a time when the premises are open for the purposes of supplying alcohol, in accordance with the club premises certificate, to members of the club for consumption on the premises.
   

  (4) The second condition is that any alcohol supplied for consumption off the premises must be in a sealed container.
   

        (5) The third condition is that any supply of alcohol for consumption off the

              premises must be made to a member of the club in person.

   

   

  Licensing Act 2003 Mandatory Conditions

   

  Mandatory conditions where licence authorises the supply of alcohol

   

   

  (1)              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

   

   

  Mandatory Condition where the licence permits the performance of Films

   

  Where a programme includes a film in the 12A, 15 or 18 category, as classified by the British board of Film Classification, no person appearing to be under the age of 12 (and unaccompanied in that case),15 or 18 as appropriate shall be admitted to any part of the programme; and the licence holder shall display in a conspicuous position a notice in the following terms-

   

  PERSONS UNDER THE AGE OF [INSERT APPROPRIATE AGE] CANNOT BE ADMITTED TO ANY PART OF THE PROGRAMME

   

  Where films of different categories form part of the same programme, the notice shall refer to the oldest age restriction.

   

  This condition does not apply to members of staff under the relevant age while on duty provided the prior written consent of the person’s parents or legal guardian has first been obtained.

   

  Immediately before each exhibition of a film passed by the British Board of Film Classification there shall be exhibited on screen for at least five seconds a in such a manner that it can be easily read by all persons in the auditorium a reproduction of the certificate of the Board or, as regards a trailer advertising a film, of the statement approved by the Board indicating the category of the film

   

  Mandatory conditions where Door Supervisors are provided

   

  All individuals who carry out security activities must be licensed by the Security Industry Authority (SIA)

   

  Mandatory Conditions for club Premises with off sales

   

  1) The supply of alcohol for consumption off the club premises must be made at a time when the premises are open for the purposes of supplying alcohol, in accordance with the club premises certificate, to members of the club for consumption on the premises.

   

  2) Any alcohol supplied for consumption off the premises must be in a sealed container.

   

  3) That any supply of alcohol for consumption off the premises must be made to a member of the club in person.

   

   

   

• ANNEX 2 - Conditions Consistent with the operating schedule

   

  1. Only known members would be admitted to the bar.

  2. Reception area monitored by CCTV whose images are displayed on a screen in the bar area.

  3. Security lights illuminate the area outside the club.

  4. First aid kit located on site.

  5. Children are allowed on the premises as long as they are accompanied by an adult / parent.

  6. At all functions, there is usually a committee person present.

  Various sections of the parish community hold plays / concerts on the ground floor / hall area of the building. This is an area where alcohol might be occasionally consumed. Such plays might only occur once or twice a year only and usually on a Sunday but occasionally on a Saturday.

  Further Details 

  We occasionally hold parish dances on an ad hoc basis. Usually 3 or 4 a year. These are held on a Saturday night and would involve a musician(s) playing live music. Sometimes we let out the hall to non members on an ad hoc basis. Possibly 2 or 3 times a year and occasionally these are held on a Friday night. The people organising the function have live music played.

  (To be read in conjunction with section E) When a non member uses the bar / hall facilities instead of a live group / musicians playing, they might use a disco / DJ instead. This non member event might take place on a Friday or a Saturday night.

  Occasionally when we have one of our parish functions we might invite a Polish Folk / dance ensemble to provide the interval entertainment. This might only occur once or twice a year - once at the annual Harvest Festival and perhaps on another ad hoc basis.
