ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. All staff shall be suitably trained for their job function for the premises. The training shall be written into a programme ongoing and under constant review and shall be made available to a relevant responsible authority when called upon. No member of staff should be permitted to sell alcohol until such time as they have successfully completed this training.
The training will cover the topics below:
• Sale of alcohol to persons under 18 (penalties)
• Age verification policies and acceptable forms of identification
• Proxy sales of alcohol to children
• Signs of drunkenness and intoxication
• Recording refusals
• The Licensing Objectives
2. CCTV system installed to cover all entry and exit points enabling frontal identification of every person entering in any light condition.
3. CCTV system continually record and cover areas where alcohol is kept for selection and purchase by the public, whilst the premises is open for licensable activities. It shall operate during all times when customers remain on the premises.
4. All recordings stored for a minimum period of 31 days and made available upon the request of Police or an authorised officer of the council throughout the preceding 31-day period.
5. A staff member from the premises who is conversant with the operation of the CCTV system, on the premises at all times when the premises are open to the public. This staff member must be able to show a Police or authorised council officer recent data or footage with the minimum of delay when requested.
6. CCTV downloaded on request of the Police or authorised officer of the council.
7. Appropriate signage advising customers of CCTV being in operation, prominently displayed in the premises.
8. Documented check of the CCTV completed monthly to ensure all cameras remain operational and the 31 days storage for recordings is being maintained. A premises daily register kept at the premises.
9. Register maintained and kept for a rolling period of 12 months. The register records all incidents occurred which are relevant to the supply of alcohol and the promotion of the licensing objectives.
10. Such incidents shall include, but not be limited to, complaints made to the premises alleging nuisance or anti-social behaviour by persons attending or leaving the premises and all refusals to sell alcohol. The register shall be readily available for inspection by an authorised person upon reasonable request.
11. All drinks promotions risk-assessed to ensure the promotion is not irresponsible. Each risk assessment considers the nature of the premises, the nature of the promotion including the size and duration of any discount and the type of customer potentially attracted by the promotion.
12. No self-service of spirits on the premises.
13. No sale by premises licence holder of super strength beer, lager or cider with an alcohol content of 6.5% ABV (alcohol by volume) or greater. This restriction shall not apply in respect of the specialist branded, premium priced, products - for example craft ales, local or micro-brewery specialist products, boxed gifts or national celebratory/commemorative beer, lager or cider with an alcohol content of 6.5% ABV or greater.
14. All exit routes and public areas kept unobstructed, have non-slippery and even surfaces, and free of trip hazards and be clearly signed.
15. All exit doors available and easily openable without the use of a key, card, code or similar means.
16. Regular checks and maintenance carried out on all equipment, electrical installations, emergency lighting and fire alarms and equipment to ensure their continued safe operation. A written record of these checks kept and made available to an authorised officer of the licensing authority.
17. The premises licence holder ensure that a suitable fire risk assessment and emergency plan is in place at all times.
18. A fire risk assessment completed and reviewed regularly. The assessment readily available for inspection by an authorised person upon reasonable request.
19. An adequate and appropriate supply of first aid equipment and materials available on the premises.
20. Signage prominently displayed in the premises requesting that customers take home any alcohol they have purchased to consume it rather than consume it in the street.
21. The premises’ frontage regularly monitored to keep it clean and clear of litter.
22. No accumulation of combustible rubbish, dirt, surplus material or stored goods permitted to remain in any part of the premises except in an appropriate place and of such quantities so as not to cause a nuisance, obstruction or other safety hazard.
23. The Licensee to adopt a “Challenge 25” policy where all customers who appear to be under the age of 25 and attempt to purchase alcohol or other age-restricted products are asked for proof of their age.
24. The Licensee to prominently display notices advising customers of the “Challenge 25” policy.
25. The following proofs of age are the only ones to be accepted:
• proof of age card bearing the PASS hologram logo;
• passport; or
• UK photo driving licence.
• A Military ID Card
26. Notices advertising that the premises operates a "Challenge 25" scheme displayed in a clear and prominent position at the premises entrance.
27. All occasions when persons have been refused service recorded in the premises daily register. The register will contain details of time and date, description of the attempting purchaser, description of the age restricted products they attempted to purchase, reason why the sale was refused and the name/signature of the salesperson refusing the sale.
28. The Refusals book to be examined on a regular basis by the DPS and date and time of each examination to be endorsed in the book. The Refusals Book will be made available on request to a Licensing Officer, Trading Standards or the Police.
29. Documented delegation of authorisations to sell alcohol maintained at the premises and available on request by the Police or an authorised officer of the Licensing Authority. A prominent clear notice displayed at the point of entry to the premises advising customers that they may be asked to produce evidence of their age if seeking to purchase alcohol.
30. An ID Log is to be kept to record dates and times where ID has been requested and to record the type of ID shown.
31. A copy of this ID Log will be made available immediately upon request to authorised officers of Rochdale Borough Council.
32. To inform all staff of changes in the law relating to age-restricted products as and when required.
33. To provide training, at least once a year, to existing staff, on the law relating to underage sales of alcohol.
34. To provide training for all new staff on the sale of age restricted products.
35. To keep written records of all training provided in respect to the law relating to underage sales of alcohol. Staff to sign and date records to confirm that the training has been received and understood.
36. To notify staff of any reports of alleged underage sale incidents that has been brought to your attention by Trading Standards.
37. To keep a log of such notifications on file, ready for inspection by authorised officers of Rochdale Borough Council if required.
38. To record any remedial action following a report from Trading Standards of an alleged underage sale from the premise.
39. To produce a copy of the ‘Record of Remedial Action’ if requested by an authorised officer of Rochdale Borough Council.
