ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. The premises will have installed and maintained a CCTV system with a minimum of 5 cameras.
2. The CCTV system has sufficient hard drive storage capacity to store a minimum of 31 days.
3. The CCTV system is capable of obtaining clear facial recognition images and a clear head and shoulders image of every person entering or leaving the premises at each exit and entrance point.
4. The Designated Premises Supervisor will ensure that the CCTV system is checked at least once every month. This check will include the operation of the cameras, the recording facilities, the facilities for providing footage and the accuracy of the time and date. A written record of these checks to be kept on the premises and made available to a police constable within a reasonable time upon request.
5. Only nominated staff will be trained in the operation of the CCTV system to ensure rapid data retrieval & downloads of footage can be provided to the Police & the Local Authority Officer upon reasonable request in accordance with the Data Protection Act.
6. CCTV will be continually recording during licensable hours.
7. In the event of a failure of the CCTV system for any reason, a record of the failure will be recorded in the premises Incident log and immediate steps will be made to rectify the problem.
8. The CCTV system will provide a clear head and shoulders view to an evidential quality on the customers entry.
9. Record footage will be provided within a reasonable time to a police constable upon request.
10. Such footage will be provided in a viewable format and to include any software etc. that is required to view the footage.
11. Posters, no smaller than A4 size, are clearly and prominently displayed at the entrance and exit of the premises stating that CCTV is in operation and that images are being captured for the purposes of crime prevention and public safety.
12. All areas are sufficiently illuminated for the purposes of the recording of CCTV images.
13. CCTV cameras cover internal and external areas of the premises and all areas where customers have legitimate access.
14. A contact number for the Designated Premises Supervisor will be available on the premises when not on duty.
15. Relevant staff will be given the appropriate training on the legislation relating to alcohol and diners under the age of 18.
16. An Alcohol register containing all the names of all persons who are authorised to sell alcohol on the premises will be completed and kept at the premises for a minimum of 12 months.
17. No open vessels are allowed to be taken outside of the ON sales area at any time.
18. Patrons are not permitted to remove open containers of alcohol from the premises save for consumption in any authorised delineated external area.
19. A zero-tolerance drug policy will be implemented.
20. Prominent, clear and legible notices will be displayed at the exit and in key areas, requesting the public to respect the needs of the local residents and to leave the premises and the area quickly and quietly.
21. All residents of the houses in the direct vicinity of the premises will be given the number of the Duty Manager in case of any issues regarding noise nuisance.
22. No waste to be disposed of between the hours of 22:00 and 08:00 every day.
23. The hours of deliveries and supplies to the premises and collection of refuse are restricted to 09:00 and 18:00 hours Monday to Saturday with no such operations on Sundays and Bank Holidays.
24. The outdoor courtyard is strictly limited for the consumption of alcohol ON sales from 12:00-17:00 every day.
25. A list of all employees is written and kept up to date showing names and dates of birth for each employee.
26. That list is provided to GMP / Licensing Authority immediately upon request.
27. The PLH will check and retain a copy of each employee UK Passport / and ensure their entitlement to work in the UK, prior to employment.
28. A written register of refusals will be kept including a description of the people who have been unable to provide required identification to prove their age. Such records shall be kept for a period of 12 months and will be collected by the designated premises supervisor and produced to the police or an ‘authorised person’ (as defined by section 13 of the licensing act 2003) or an authorised trading standards officer the local authority/council on demand.
29. The premises operates a Challenge 25 policy. Such policy is written down and kept at the premises. The policy will be produced on demand of the police or an ‘authorised person’ (as defined by section 13 of the licensing act 2003) or an authorised trading standards officer the local authority/council.
30. All staff engaged in the sale of alcohol are trained in Challenge 25. Training records are kept on the premises and produced to the police or an ‘authorised person’ (as defined by section 13 of the licensing act 2003) or an authorised trading standards officer of the local authority/council on demand.
The only acceptable forms of identification allowed are:
a) a valid passport,
b) a valid photo ID driving licence or
c) a valid proof of age scheme card with the PASS approved hologram.
31. Written records will be kept of all age verification training, with staff signing and dating the records to confirm that the training has been received and understood.
32. The training will be refreshed every 6 months
33. To record any remedial action following a report from Trading Standards of an alleged underage sale from the premise.
34. Prominent, clear and legible Challenge 25 signage displayed at all entrances to the premises as well as at, at least one location behind any counter advertising the scheme operated.
35. Proxy signs will be fitted near to all alcohol P.O.S positions warning people not to buy alcohol for children.
36. No person under the age of 18 shall be permitted to enter or remain on the premises beyond 19:00hrs.
37. Prominent, clear, and legible notices must be displayed at all exits requesting that customers respect the needs of local residents and to leave the premises and area quietly.
38. Customers are to be prevented from leaving the premises with glasses or open bottles.
39. The DPS or premises licence holder must develop and operate a dispersal policy for clientele leaving the premises.
40. A zero-tolerance drug policy will be implemented
