  The following conditions apply unless they have been superseded by provisions of the Licensing Act 2003.

   

  Off Licence

   

   

  Licensing Act 2003 Mandatory Conditions

   

  Mandatory conditions where licence authorises the supply of alcohol

   

   

  (1)              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

   

  From 1st October 2010 these conditions will also apply

   

  (3)              (a) The premises licence holder or club certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

                (b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

   

• ANNEX 2 - Conditions Consistent with the operating schedule

   

  1. CCTV installed and maintained in good working order

  2. CCTV images retained for 1 month and produced on request to the police and Council Officers

  3. Images recorded digitally on a hard drive

  4. CCTV fully operational at all times premises are open

  5. Staff trained in the use of CCTV

  6. Staff member who can operate CCTV is on premises at all times

  7. No alcohol sold if the CCTV is not operable and no alcohol sold until it is working again

  8. Refresher training every 3 months on the law relating to underage sales

  9. Records kept of training and staff to sign and date records agreeing training received and understood

  10. Member of Rochdale's Responsible Retailer Scheme

  11. Challenge 25 Policy in operation at the premsies at all times

  12. All staff check ID of persons who appear to be less than 25 years old. Acceptable forms of I.D. are passport, photographic driving licence or a PASS approved proof of age card

  13. Challenge 25 posters clearly and prominently displayed

  14. Attend training organised by RMBC

  15. Notify staff of any incidents/complaints of underage sales that have have been brought to the attention of the DPS

  16. Record, and produce record, of any remedial action following a report from Rochdale MBC of an alleged underage sale
