  The following conditions apply unless they have been superseded by provisions of the Licensing Act 2003.

   

   

   

   

  Licensing Act 2003 Mandatory Conditions

   

  Mandatory conditions where licence authorises the supply of alcohol

   

   

  (1)              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Mandatory Condition where the licence permits the performance of Films

   

  Where a programme includes a film in the 12A, 15 or 18 category, as classified by the British board of Film Classification, no person appearing to be under the age of 12 (and unaccompanied in that case),15 or 18 as appropriate shall be admitted to any part of the programme; and the licence holder shall display in a conspicuous position a notice in the following terms-

   

   

  PERSONS UNDER THE AGE OF [INSERT APPROPRIATE AGE] CANNOT BE ADMITTED TO ANY PART OF THE PROGRAMME

   

  Where films of different categories form part of the same programme, the notice shall refer to the oldest age restriction.

   

  This condition does not apply to members of staff under the relevant age while on duty provided the prior written consent of the person’s parents or legal guardian has first been obtained.

   

  Immediately before each exhibition of a film passed by the British Board of Film Classification there shall be exhibited on screen for at least five seconds a in such a manner that it can be easily read by all persons in the auditorium a reproduction of the certificate of the Board or, as regards a trailer advertising a film, of the statement approved by the Board indicating the category of the film

   

   

  Mandatory conditions where Door Supervisors are provided

   

  All individuals who carry out security activities must be licensed by the Security Industry Authority (SIA)

   

  Mandatory Conditions for club Premises with off sales

   

  1) The supply of alcohol for consumption off the club premises must be made at a time when the premises are open for the purposes of supplying alcohol, in accordance with the club premises certificate, to members of the club for consumption on the premises.

   

  2) Any alcohol supplied for consumption off the premises must be in a sealed container.

   

  3) That any supply of alcohol for consumption off the premises must be made to a member of the club in person.

   

   

   

   

   

   

• ANNEX 2 - Conditions Consistent with the operating schedule

   

  1.  The premises will liaise and co-operate with the responsible authorities.

  2.  A proof of age policy will operate in relation to relevant licensable activities.

  3.  A zero tolerance towards illegal drugs will operate at all times.

  4.  Any drinks promotions will not adversely affect the promotion of responsible drinking.

  5.  Customers will be encouraged to leave the premises in a quiet and orderly manner.

  6.  Staff will be trained to observe the measures necessary to promote the crime and disorder objective, public safety objective, prevention of public nuisance objective and protect children from harm objective.

  7.  The premises will operate in accordance with all relevant legislation which promotes the public safety objective including, but not limited to, the Health and Safety At Work etc Act 1974 and associated regulations, the Food Safety Act 1990, the Regulatory Reform (Fire Safety) Order 2005 and the Disability Discrimination Act 1975.

  8.  The existing fire safety precautions will be retained and maintained.

  9.  The premises will operate in accordance with all relevant legislation which promotes the public nuisance objective including but not limited to the Environmental Protection Act 1990 and the Noise Act 1996.

  10.  The premises will be adequately ventilated to prevent nuisance.

  11.  Arrangements will be made for the storage and disposal of refuse which do not cause a nuisance.

  12.  Any noise from the licensable activities provided will be monitored in order to prevent nuisance.

  13.  Noise limiters on amplification equipment will be used.

  14.  All windows and doors shall be kept closed during live musical entertainment except for access and egress to the premises and in the event of an emergency.

  15.  Prominent, clear and legible notices will be displayed at all exits requesting patrons to respect the needs of local residents and to leave the premises and the area quietly.

  16.  The Licence Holder or his representative shall conduct regular assessments of the noise coming from the premises when music is playing and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents.

  17.  A written record shall be made of those assessments in the log book kept for that purpose that shall include the time and date of the checks, the persons making them and the results including any remedial action.

  18.  The playing of live music and karaoke will cease at 23:00 hours.

  19.  Non-alcoholic drinks will be available.
