ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. All staff shall be suitably trained for their job function for the premises. The
training shall be written into a programme ongoing and under constant review and shall be made available to a relevant responsible authority when called upon.
2. All staff shall be trained in their responsibilities under the Licensing Act 2003 and in regards to the terms and conditions of this licence.
3. Such training should include the prevention of sales of alcohol to underage persons, and the challenge 25 scheme in operation at the premises.
Records pertaining to such training shall be kept / be accessible at the premises at all times, shall be updated every 6 months and shall be made immediately available for inspection at the premises to council and / or police officers on request.
4. A Dispersal Policy will be implemented and maintained to assist with patrons leaving the premises in an orderly and safe manner and all relevant staff will be trained in the contents of this policy and made aware of any changes.
5. A record of this training will be kept including the date and the trainees name and made available for inspection when requested. A copy of the dispersal policy shall be made available to the licensing officer and the police on request.
6. A CCTV system shall be installed to cover all entry and exit points enabling frontal identification of every person entering in any light condition.
7. The CCTV system shall continually record whilst the premises is open for licensable activities. It shall operate during all times when customers remain on the premises.
8. All recordings shall be stored for a minimum period of 31 days with correct date and time stamping and shall be made available immediately upon the request of Police or an authorised officer of the council throughout the preceding 31day period.
9. The CCTV system shall be updated and maintained according to police recommendations.
10. A staff member from the premises who is conversant with the operation of the CCTV system, shall be on the premises at all times when the premises are open to the public.
11. This staff member must be able to show a Police or authorised council officer recent data or footage with the absolute minimum of delay when requested.
12. CCTV shall be downloaded on request by the Police or authorised officer of the council.
13. Appropriate signage advising customers of CCTV being in operation, shall be prominently displayed in the premises.
14. A documented check of the CCTV shall be completed weekly to ensure all cameras remain operational and the 31 days storage for recordings is being maintained.
15. A premises daily register shall be kept at the premises. This register shall be maintained and kept for a rolling period of 12 months.
16. The register shall record all incidents which may have occurred which are relevant to the supply of alcohol and the promotion of the licensing objectives. Such incidents shall include, but not be limited to, complaints made to the premises alleging nuisance or anti-social behaviour by persons attending or leaving the premises and all refusals to sell alcohol.
17. An incident log shall be kept at the premises, and made available for inspection on request to an authorised officer of the Council or the Police, which will record the following:
(a) all crimes reported to the venue
(b) all ejections of patrons
(c) any complaints received
(d) any incidents of disorder
(e) all seizures of drugs or offensive weapons
(f) any faults in the CCTV system or searching equipment or scanning equipment
(g) any visit by a relevant authority or emergency service.
18. The register shall be readily available for inspection by an authorised person upon reasonable request.
19. Super-strength lagers, beers and/or ciders, i.e. those with an ABV of 6.5% or higher, shall not be sold at the premises.
20. Any events held at the premises shall be by way of a pre-paid ticket or private hire only.
21. For the purpose of this condition an "event" is where:
a. The event is held and promoted by the premises licence holder by way of a ticketed event; or,
b. The premises, either wholly or in part, is hired by a third party for money; and
c. The hire is promoted to the public; and
d. The third party charges an entry fee to the public.
22. Any outside hirers shall be given a copy of the following:
a. The premises'' Challenge 25 policy
b. The premises'' Dispersal Policy
c. A copy of the Premises Licence including the conditions
23. Prior to the commencement of the event the hirer shall be required to sign a declaration confirming that they have received and understand the above documents. This declaration shall be kept at the premises for a period no less than 12 months and shall be made available to the Police or authorised officers from the Council upon request.
24. The premises licence holder shall ensure that any events advertised as taking place at the premises, correctly advertise the premises'' permitted hours and the premises'' re-entry condition correctly.
25. The premises licence holder shall also ensure that any other conditions of the licence displayed as part of the advertisement are correctly stated.
26. Where an advertisement displays incorrect information the premises licence holder shall ask the hirer in writing to correct the advertisement.
27. Contact details of all outside hirers/DJ''s shall be logged and kept at the premises for a period of 12 months and made available for inspection by police and relevant authorities upon request.
28. These contact details shall include; full name, address, telephone and email address.
29. Door supervisors of a sufficient number and gender mix.
30. 2 x SIA Door Supervisors from 20:00hrs to terminal hour (close) - Friday to Sunday.
31. Any functions taking place to require an additional SIA Door Supervisors from 20:00hrs to terminal hour (close) - Friday to Sunday.
32. Sale or supply of alcohol to cease at 00:30hrs Sunday to Thursday inclusive.
33. Sales of Alcohol to cease at 01:30hrs Friday to Saturday inclusive.
34. All other licensable activities to cease at 01:30hrs Friday to Saturday inclusive.
35. Premises to close at 02:00hrs Friday to Saturday inclusive.
36. A list of all employees their addresses and dates of birth to be available for inspection to GMP / RBC Licensing Officers immediately upon request.
37. An employee of La Strada Club Ltd - (Premises Licence Holder), who holds a personal licence, to be at the premises Monday to Sunday from 20:00hrs to close.
38. SIA Security shall wear clothing that can be clearly and easily identified on CCTV.
37. A register/log containing the names, badge number, dates & times of duty of security staff and any incidents that occur shall be kept at the premises for a period of 12 months and made available to the Police and Licensing Authority.
39. SIA Security shall monitor the egress of customers at the end of the night and shall remain at the premises until the final customers have left.
40. No entry or re-entry shall be permitted after 23:00 hours on Monday to Thursday and 01.00hrs on Friday, Saturday and Sunday until the premises is closed to the public. This condition shall not apply to persons using the Designated Smoking Area.
41. Notices clearly explaining the licensee''s drugs and weapons policy shall be displayed at the entrance and at suitable places throughout the premises.
42. A more detailed policy shall be kept at the premises and made available to the Police and Licensing Authority.
43. Notices explaining the Premises Licence Holder''s admission and search policies shall be displayed at the entrance to the Premises.
44. After 20.00hrs, toilets shall be checked every two (2) hours for the use of drugs and other illegal activities.
45. A toilet check list shall be displayed on the wall in all toilets. Staff shall use these checklists to record their name and certify the time of the check.
46. Checklists are to be replaced daily and old checklists must be retained for a period of 12 months and made available for inspection by the Police and authorised officers from the Council.
47. All exit routes and public areas shall be kept unobstructed, shall have non-slippery and even surfaces, shall be free of trip hazards and shall be clearly signed.
48. The premises licence holder shall ensure that a suitable fire risk assessment and emergency plan is in place at all times.
49. Regular checks and maintenance shall be carried out on all equipment, electrical installations, emergency lighting and fire alarms and equipment to ensure their continued safe operation.
50. A written record of these checks shall be kept and made available to an authorised officer of the licensing authority.
51. Empty glasses and bottles shall be removed from public areas quickly and efficiently.
52. Customers shall not be permitted to take open glass containers outside the premises as defined on the plan submitted to and approved by the Licensing Authority.
53. An adequate and appropriate supply of first aid equipment and materials shall be available on the premises.
54. Noise management policy to be implemented
55. Arrangements shall be put in place to ensure that waste collection contractors do not collect refuse between 19:00 and 07:00.
56. No person shall be allowed to leave the licensed area whilst in the possession of any drinking vessel or open glass bottle, whether empty or containing any beverage.
57. The Premises Licence Holder shall devise and implement a Dispersal Policy for the Premises to ensure that customers leave the Premises in a quiet and orderly fashion. A copy of the Dispersal Policy shall be kept at the Premises and made available to the Police or Authorised Officers from the Council upon request.
58. The premises licence holder shall ensure that any patrons drinking and/or smoking outside the premises do so in an orderly manner and ensure that there is no public nuisance.
59. Notices asking customers to respect our neighbours and keep noise to a minimum will be displayed at all entrances and exits and various locations around premises. Including the beer garden and any areas used for smoking.
60. Smoking areas will be contained as far away from neighbouring residential properties as possible. This includes the terraced area.
61. The use of the terraced area will cease at 23:00hours with the exception of smoking.
62. After 23:00hours most of the terrace, especially nearest to the residential properties will be cordoned off and not used. This will be done effectively so there is no use of any outside furniture or heaters after this time. This is to discourage people from staying outside for as long than necessary, therefore reducing any likely nuisance from loud voices.
63. No drinks will be consumed in the smoking area or terrace after 23:00. A notice will be placed advising customers of this condition.
64. Management will also undertake regular door checks to ensure no noisy disturbances take place outside and if any do occur management will resolve them as quickly as possible either by:
- Asking customers to move inside when they have finished smoking.
- Encouraging customers to continue on their home/onward journey quickly, especially if they refuse to quieten
65. If door staff are on duty it will be part of their role to ensure that any noise is kept to an acceptable level. If no door staff it will be the responsibility of the duty manager.
66. No form of licensable activities authorised by the premise licence shall be played through speakers installed on the roof terrace or any other outside areas after 21:00hours.
67. A Challenge 25 proof of age scheme shall be operated at the premises where the only acceptable forms of identification are the following recognised photographic identification cards:
• a driving licence,
• a passport,
• a military identification card or
• a Proof of Age card carrying a ‘PASS’ logo.
68. Notices advertising that the premises operates a "Challenge 25" scheme shall be displayed in a clear and prominent position at the premises entrance.
69. All occasions when persons have been refused service shall be recorded in the premises daily register.
70. No children shall be admitted unless accompanied by a responsible adult. Persons under 18 will not be permitted to remain on the premises after 22:00hrs.
71. The premise licence holder or Designated Premises Supervisor to ensure that all management and staff who are not personal licence holders are fully trained and briefed on the four licensing objectives and Challenge 25 and they are adhered to.
