ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. Last entry to the Premises will be at 0100hrs, and no re-admission after 01:00hrs.
2. A log of SIA supervisors must be kept and produced immediately upon request to Authorised Licensing Officers / Police. SIA Log must include the following:
SIA Licence number and expiry date
Name of SIA door supervisor
Date of birth
Duty commencement time
Duty cessation time
Signature of SIA door supervisor
3. SIA door supervisors to conduct bag searches on all persons entering the Premises with bags.
4. A metal detecting “wand” to be used to check all persons entering the Premises.
5. All incidents of fighting, drugs, weapons will be reported to GMP immediately by phone
6. All incidents are also to be reported in real time via town centre radio link
7. A log of all incidents stating date, time, description of incident / offender / all other relevant information is maintained and produced immediately upon request to the Police
8. CCTV footage of the incident is to be retained in accordance with CCTV conditions attached to the licence.
9. If any individual is found to be in possession of a small amount of drugs for personal use following a search, the SIA registered supervisor conducting the search will advise the individual that the drugs in question will not be returned to them and that the drugs will be handed to the police for destruction. The drugs seizure will be captured on the CCTV, in accordance with the CCTV condition herein. Following this the date, time and name of the person who seized the drugs, together with the suspected type of drug, will be recorded in a ‘Drugs Book’ to be kept on the Premises and then secured within a safe on the Premises. Police Officers will attend on an agreed weekly or fortnightly basis to collect any drugs from the safe for destruction, and the Officers will sign the ‘Drugs Book’ to confirm the drugs have been removed from the Premises and handed to the Police.
10. A digital hard drive CCTV system must be in operation
11. CCTV cameras to cover internal and external areas of the Premises and all areas where customers have legitimate access (Excluding Toilets)
12. One CCTV camera to be specifically positioned to capture facial images of any
persons entering the Premises at the main entrance and all other entrances
13. All areas to be sufficiently illuminated for the purposes of the recording of CCTV images
14. All CCTV recorded images to have sufficient clarity/quality/definition to enable facial recognition.
15. CCTV images to be retained in an unedited format for a period of 31 consecutive days.
16. Any person left in charge of the Premises must be trained in the use of any such CCTV equipment and able to produce/download/burn CCTV images.
17. CCTV to be maintained on a regular basis and kept in good working order at all times and images shall be produced to the Police or Authorised Licensing Officers (Rochdale Council Licensing Service) immediately upon request.
18. The CCTV system to record images at all times that any member of the public is at or on the Premises. For the purpose of this condition a “member of the public” is defined as is any person other than the DPS, Premises Licence Holder, Spouse, Partner or Employee thereof.
19. A TV monitor to be placed at the entrance relaying live images of all persons entering the Premises.
20. Posters, no smaller than A4 size, are to be clearly and prominently displayed at the entrance and exit of the Premises stating that CCTV is in operation and that images are being captured for the purposes of crime prevention and public safety
21. Posters no smaller than A4 size clearly to be prominently displayed stating that bag searches are undertaken
22. Posters no smaller than A4 size, to be clear and prominently displayed stating Premises operate a zero tolerance to drugs.
23. All keg beers and ciders, wines, spirits and soft drinks must be served in polycarbonate drinking vessels
24. A member of management who is a personal licence holder must be on the Premises at all times the Premises is open to the Public
25. The Premises must have 24/7 mobile contact number working at all times.
26. A list of all employees must be written and kept up to date each night showing names and dates of birth for each employee and the start and finish times of their work shift that day
27. Challenge 25 policy in place.
28. Driving licences, passports, or a “PASS” proof of age card will be the only form of I.D accepted
29. No persons under the age of 18 years permitted on the Premises at any time unless it is a family function.
30. To ask for appropriate identification of proof of age with a photograph of the person displayed on the I.D. Appropriate identification is limited to a passport, photo driving licence or a ‘PASS’ proof of age card.
31. An ID Log is to be kept to record dates and times where ID has been requested and to record the type of ID shown.
32. A copy of this ID Log will be made available immediately upon request to authorised officers of Rochdale Borough Council.
33. A Refusals Log is to be kept to record dates and times of all refusals to retail alcohol to underage persons.
34. A copy of the Refusals Log will be made available immediately upon request of authorised officers of Rochdale Borough Council.
35. Challenge 25 scheme operated at premises.
36. Challenge 25 posters to be clearly and prominently displayed.
37. To inform all staff of changes in the law relating to age-restricted products as and when required.
38. To provide training, at least once a year, to existing staff, on the law relating to underage sales of alcohol.
39. To provide training for all new staff on the sale of age restricted products.
40. To keep written records of all training provided in respect to the law relating to underage sales of alcohol. Staff to sign and date records to confirm that the training has been received and understood.
41. To notify staff of any reports of alleged underage sale incidents that has been brought to your attention by Trading Standards.
42. To keep a log of such notifications on file, ready for inspection by authorised officers of Rochdale Borough Council if required.
43. To record any remedial action following a report from Trading Standards of an alleged underage sale from the premise.
44. To produce a copy of the ‘Record of Remedial Action’ if requested by an authorised officer of Rochdale Borough Council.
45. Adopt and comply with the British Beer and Pub Associations Guidelines on On-Trade Promotions.
46. Glass bottles that are used, will be retained or disposed of on the premises
47. No customers will be admitted, or permitted to leave when carrying open or sealed bottles or glasses.
48. The consumption of alcohol is restricted to the areas identified on the plan attached to the operating schedule.
49. A secure deposit box is kept on the premises for the retention of confiscated items and ensure that the Police are advised of any items which require safe disposal.
50.Responsible for the disposal of waste on the frontage of the premises and make provision for the emptying of litter bins in the vicinity of the premises.
51. Escape routes and exits, including external exits, are maintained to ensure that they are not obstructed, in good order with non-slippery and even surfaces, free of trip hazards and clearly identified.
52. Where chairs and tables are provided, internal gangways are kept unobstructed.
53. All exit doors are easily openable and do not require the use of a key, card, code or similar means
54. Doors at such exits are regularly checked to ensure that they function satisfactorily and a record of the check is kept.
55. Security fastenings are removed whenever the premises are open to the public or occupied by staff.
56. All fire doors are maintained effectively selfclosing and not held open other than by approved devices (for example, electromagnetic releases operated by smoke detectors).
57. Fire resisting doors to ducts, service shafts, and cupboards are kept locked shut.
58. Edges of the treads of steps and stairways are maintained so as to be conspicuous.
59. Safety checks are carried out before the admission of the public or club members and guests; and details of such checks are kept in a Log-book.
60. Hangings, curtains and temporary decorations are maintained in a flame-retardant condition
61. Any upholstered seating meets on a continuous basis the pass criteria for smouldering ignition source 0, flaming ignition source 1 and crib ignition source 5 when tested in accordance with section 5 of Bs 5852:1990.
62. Hangings, curtains and temporary decorations are arranged so as not to obstruct exits, fire safety signs or firefighting equipment.
63. Temporary decorations are not used without prior notification to the licensing authority/fire authority.
64. Notices detailing the action to be taken in the event of fire or other emergencies, including how the fire brigade should be summoned, are prominently displayed and protected from damage and deterioration.
65. The fire brigade will be called at once to any outbreak of fire, however slight, and the details recorded in a Fire Log-book.
66. I will notify the local Fire Control Centre as soon as possible if the water supply to any hydrant, hose reel, sprinkler, drencher or other fire extinguishing installation is cut off or restricted.
67. Access for emergency vehicles is kept clear and free from obstruction.
68. Adequate arrangements exist for Disabled people to enable their safe evacuation in the event of an emergency, and that patrons are made aware of these arrangements.
69. Adequate and appropriate supply of first aid equipment and materials is available on the premises.
70. At least 1 trained first aider will be on duty when the public are present. If more than one first-aider is present, I will make sure that their respective duties are clearly defined.
71. the absence of adequate daylight, I will make sure that the lighting in any area accessible to the public is fully operational
72. Fire safety signs are adequately illuminated.
73. I will not alter Emergency lighting without prior notification to the Licensing Authority.
74. Emergency lighting batteries are fully charged before admission of the public.
75. In the event of failure of normal lighting, where the emergency lighting battery has a capacity of one hour, I will make sure that evacuation of the premises is possible within 20 minutes. Where the emergency lighting battery has a capacity of three hours, I will make sure that evacuation of the premises is possible within one hour.
76. I will not provide temporary electrical wiring and distribution systems without prior inspection by a suitably qualified electrician
77. Any temporary electrical wiring and distribution systems comply with the recommendations of BS 7671 or where applicable BS 7909.
78. Where temporary electrical wiring and distribution systems have not been installed by a competent person, they are inspected and certified by a competent person before they are put to use.
79. The following systems are maintained and inspected by suitably qualified professional persons in accordance with any British Standards and at intervals recommended in national guidance, and will keep the records of such inspections available for inspection by authorised officers on request:
· Building Electrical Installation
· Emergency Lighting System
· Fire Warning System
· Gas boiler, calorifier or appliance
80. Public information notices about crime and disorder issues are displayed at the request of the Council or the local Constabulary. (e.g. Customer Code of Conduct)
81. Display any conditions of entry to the premises in the vicinity of any entrance to the premises.
82. Any request by an authorised officer of the Council in relation to reducing noise levels is complied with.
83. The placing of bottles into receptacles outside the premises takes place at times that will minimise disturbance to nearby properties.
84. Display prominent, clear and legible notices at all exits requesting patrons to respect the needs of local residents and to leave the premises and the area quietly.
85. Offensive smells from the licensed premises are not permitted so as to cause a nuisance to nearby properties and the premises are properly vented.
86. Receptacles for waste are emptied regularly to minimise nuisance smells.
87. Flashing or particularly bright lights on or outside the licensed premises do not cause a nuisance to nearby properties, whilst balancing the need for lighting in the interests of prevention of crime and disorder.
88. Provide adequate and suitable (lidded) receptacles to receive and store refuse from the premises/site.
89. Receptacles for refuse storage are maintained in a clean condition.
90. Litter is regularly cleared from the vicinity of the premises.
