  Annex 1

   

  The following conditions apply unless they have been superseded by provisions of the Licensing Act 2003.

  Licensing Act 2003 Mandatory Conditions

   

  Mandatory conditions where licence authorises the supply of alcohol

   

   

  (1)              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

   

  The Licensing Act 2003 (Mandatory Licensing Conditions) (Amendment) Order 2014

   

  (3.-(1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

   

  (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

   

  (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either-

   

  (a) a holographic mark, or

  (b) an ultraviolet feature.

   

   

  The Licensing Act 2003 (Mandatory Conditions) Order 2014

  1. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

   

  2. For the purposes of the condition set out in paragraph 1-

  (a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;

  (b) “permitted price” is the price found by applying the formula-

   

  P = D + (D×V)

   

  where-

   

  (i) P is the permitted price,

  (ii) D is the amount of duty chargeable in relation to the alcohol as if the duty were

  charged on the date of the sale or supply of the alcohol, and

  (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;

   

  (c) “relevant person” means, in relation to premises in respect of which there is in force a premises licence-

  (i) the holder of the premises licence,

  (ii) the designated premises supervisor (if any) in respect of such a licence, or

  (iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence;

   

  (d) “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

   

  (e) “value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994.

   

  3. Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.

   

  4.-(1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.

   

  (2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  1.              All staff shall be suitably trained for their job function for the premises. The training shall be written into a programme ongoing and under constant review and shall be made available to a relevant responsible authority when called upon.

  2.              All sales shall be made remotely via the internet or telephone.

  3.              All purchases made for collection must be made in advance.

  4.              All collections shall be by appointment only

  5.              No member of the public will be permitted within the interior of the premises.

  6.              A CCTV system will be installed and working to the satisfaction of Thames Valley Police and the Licensing Authority. The cameras must give clear coverage all areas of the premises where licensable activities take place. Coverage must include all entrance and exit points of the premises.

  7.              CCTV recordings must be maintained for a period of 28 days.

  8.              If the CCTV equipment fails, the Police and the Licensing Authority will be informed as soon as reasonably practicable and immediate steps will be taken to put the equipment back into working order.

  9.              DPS and/or nominated person must be trained on how to work the CCTV system to the standard where they can download any potential evidence required by Police, Local Authority Licensing Officers or relevant Agencies. DPS and/or nominated person is responsible for supplying the necessary media (discs, data stick) containing any downloaded content.

  10.              The premises will have a suitable alarm system

  11.              Alcohol shall not be on view from the exterior of the premises.

  12.              The premises shall provide a safe loading area for collection of pre-ordered alcohol

  13.              The premises licence holder shall ensure that a suitable fire risk assessment and emergency plan is in place at all times.

  14.              The premises licence holder shall ensure that an electrical compliance check is made at least once a year.

  15.              No accumulation of combustible rubbish, dirt, surplus material or stored goods shall be permitted to remain in any part of the premises except in an appropriate place and of such quantities so as not to cause a nuisance, obstruction or other safety hazard.

  16.              No deliveries will take place to the premises 19.00 and 7.00

  17.              Alcohol shall not be delivered to a person in a public place (E.g.car Park, street corner, bus stop etc.)

  18.              All sales of alcohol shall be in sealed containers

  19.              Where alcohol is offered for sale and delivery or collection on the internet or over the telephone the following terms shall apply:

  a) Orders are only acceptable from customers over the age of 18

  b) A "Challenge 25" scheme is operated and customers who appear under the age of 25 will be required to produce a valid form of identification before the consignment of alcohol is delivered to them.

  c) The only acceptable forms of ID are:

  i. proof of age card bearing the PASS logo;

  ii. passport; or

  iii. UK photo driving licence.

  iv. A military ID Card

  d) Alcohol will not be delivered to any person who is challenged and fails to provide an acceptable form of ID.

   

  1.              There shall be the following statement on the premise’s website before point of order:

  2.              “You must be 18 years old or over to purchase alcohol from this website. Be aware that purchases of alcohol are subject to a ‘Challenge 25’ age verification scheme. It is a criminal offence for anyone under the age of 18 to buy or attempt to buy alcohol, and for anyone buying or attempting to buy alcohol for persons under the age of 18. All purchases and attempted purchases are recorded.”

  3.              Premises to use a refusals book, which is to record any attempted order by persons suspected to be under 18 or fail to show suitable ID and to record evidence of those suspected to be underage but do prove that they are over 18.

  4.              All deliveries will be made by a reputable courier who has a relevant age verification process or the premises Licence holder, or a direct employee of the Premises Licence holder.

  5.              Where deliveries are made by the Premises Licence holder, or a direct employee of the Premises Licence holder, the person making the delivery shall carry a book, or other form of record, in which they shall record the date, time and circumstances under which any challenge is made in accordance with the "Challenge 25" scheme.

  6.              A version of this record, which must be kept in English, shall be made available for inspection by any police, community support or authorised Council officer upon demand. The Designated Premises Supervisor shall frequently check the record to ensure all staff are using it and shall sign and date it immediately after the latest entry as a record of doing so.

  7.              All staff employed in the sale of alcohol shall be trained in respect of the law relating to the sale of alcohol, the company’s proof of age policy and the procedure on handling and recording refusals. Training must be documented, and details made available upon request by the Police, Trading Standards Officers and Licensing Officers. Training shall be reviewed and updated on an annual basis.
