ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
General Conditions
In respect of On-Site sales
1. A Senior Member of Staff is on site at all times the premises is open to the public.
2. All staff employed will have authority to reside in the UK and be permitted to work in the UK.
3. Staff details will be maintained and records kept, these will be made available to the Police and any other relevant authority on request.
4. Training takes place at commencement of employment and every 12 months thereafter.
5. Training provided to all staff upon induction, regarding age restricted products and Challenge 25 Policies before they serve behind any bar area.
6. Records kept of all training provided and signed by staff to confirm training received and understood. These records should be made available to an authorised officer on request.
7. All staff updated and informed of the changes in the law relating to the sale of age restricted products as and when required.
8. All staff notified of any reports of alleged underage sales incidents that have been brought to the attention of management by Trading Standards Service.
9. A log of such notifications kept on file and available on request of an authorised officer.
10. Remedial action recorded following a report of an alleged underage sale from the premises, a copy of record made available to an authorised officer on request.
11. Challenge 25 Policy in place.
12. Posters, displaying Challenge 25 Policy clearly and prominently displayed at relevant alcohol sale points throughout the premises.
13. Refusals log maintained
14. Refusal log produced on request to Police / Licensing Authority upon request.
15. Only forms of acceptable identification are: Photo driving licence, Passport and a Proof of Age Scheme Card which carries the PASS hologram.
16. Any off sale should be sold in a sealed container and conveyed within a plain none transparent paper bag. In the case of a case purchase a plain box.
17. Should any large scale event/celebration take place where number exceed 50+ consideration should be given to the employment of SIA door securities. Any event/celebration where numbers exceed 75+ SIA staff will then be supplied by a registered SIA company.
18. In the event SIA door supervisors are required, a register will be maintained recording the following details: SIA licence number, licence expiry date, name, duty commencement date/time, duty cessation time and the individual’s signature. This register made available to authorised officers on request.
CCTV
19. Digital CCTV system installed and in operation.
20. CCTV retained in a secure environment, or locked office.
21. CCTV system installed so as to ensure no “Black Spots”.
22. All areas sufficiently illuminated for the purpose of CCTV images
23. CCTV records at all times members of the public are on the premises.
24. CCTV system shows correct time(s) and date(s)
25. CCTV cameras cover internal and external areas of the premises and all areas where customers have legitimate access (excluding toilets).
26. At least one CCTV camera specifically positioned to capture facial images of any person entering the premises at every entrance.
27. CCTV images to be of evidential quality and capable of facial recognition
28. CCTV images retained for a minimum period of 31 consecutive days.
29. A person capable of operating the CCTV always available and able to produce, download or burn CCTV images if requested by Police or other relevant Licensing Authority.
30. CCTV checks/maintenance carried out regularly and kept in good working order, (Suggestion- weekly system check).
31. Alcohol NOT to be served if CCTV found not to be working. (Home deliveries are still permitted).
32. Posters displayed in a prominent position at the entrances and exits of the premises notifying members of the public that CCTV is in operation and images are being captured for the purposes of Crime Prevention and Public Safety.
33. Displayed posters to be no smaller than A4 size.
Protection of children from harm
34. Poster clearly and prominently displayed at point of entry detailing entry policy as regards age restrictions. (No children allowed unless accompanied by a responsible adult aged 18 or over, see Challenge 25 restrictions)
35. Age restrictions clearly and prominently displayed on corporate web site and all promotional materials used, including all social media platforms and booking apps.
Alcohol Home Deliveries - proposed Licence conditions
These are in-line with new Licence variations at a local Brewery and Town Centre establishments
36. In the absence of a bespoke, tailored food menu with a minimum delivery value of £25, all Local alcohol deliveries made directly by Pictish Brewing Company Ltd, a minimum of 8 hours between ordering and delivery of orders containing drinks only. For local deliveries an experienced Senior Member of staff who is well versed in age restrictions to act as designated delivery Driver from Pictish Brewery.
37. All local deliveries completed by 2130 hours. Orders for courier delivery would be a minimum of next day delivery from ordering.
38. For national/out of area courier deliveries, all alcohol items will be packaged and clearly labelled to show that the package contains age restricted items (e.g. over 18s only).
39. In order to provide transparency and an audit trail, all alcohol products will be delivered to persons aged 18 or above and will be signed for. (Please see temporary condition 10, below for information in respect of absence of customer signature).
40. A "Challenge 25" process will be adopted on delivery, with age verification using Passport, Driving Licence or Proof of Age Scheme Card which carries the PASS Hologram.
41. The point of sale once an order is received and the subsequent dispatch address for food/alcohol will always be the premises as shown on the licence.
42. A record of all sales and deliveries will be kept, including ID verification procedures. In respect of Courier Services and upon request for information, this will be in line with the companies GDPR and data protection compliance policies. In respect of local sales and deliveries those records will be made available to Police or other relevant authority for inspection.
43. Both Courier and Local Deliveries aided by time constraints in condition 1 will be conducted in such a manner to avoid causing disturbance to nearby residents.
Temporary Restrictions until Relaxation of Covid - 19 Legislation
44. No large alcohol deliveries will take place to any address which will break up to date/current Government Covid Legislation at the time the order is made.
45. There will be a minimum of 24 hours between alcohol deliveries at the same address.
46. In place of a signature, the name of the person accepting the delivery will be provided to the Courier (and must correspond with the ID - if shown); a record of this will be kept.
