ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. A member of staff with a personal licence to be present at all times the premises is open to the public
2. The premises licence holder will only employ persons who have a legal entitlement to reside and work in the UK. Copies of proof of entitlement will be retained by the licence holder where necessary and produced for inspection when requested by any relevant authority.
3. Names, dates of birth, addresses and National Insurance numbers of all employees will be recorded and produced for inspection when requested by any relevant authority
4. CCTV installed and operational with a digital system of sufficient quality to enable facial recognition
5. CCTV checked daily and records of check maintained. Records of checks to be made available to the Police or other relevant authority immediately on request
6. CCTV maintained on a regular basis and kept in good working order at all times
7. CCTV images retained for a period of 31 days and images made available to the Police or other relevant authority upon request
8. CCTV cameras to be positioned on the exterior to cover entrances at both front and rear of the premises
9. CCTV to be positioned at the top of staircases, the bar and main serving areas and all areas where customers have legitimate access (not toilets)
10. Posters, no smaller than A4 size, clearly and prominently displayed at the entrance and exit of the premises stating that CCTV is in operation and that images are being captured for the purpose of crime and prevention and public safety
11. All SIA staff will be SIA registered and provided by an SIA registered company
12. All SIA staff will wear garments with hi-visibility bands as a minimum requirement
13. On ALL Fridays, Saturdays, AND Sundays prior to Bank Holiday Mondays, Christmas Eve, Boxing Day night, New Year’s Eve, Valentine’s Day night, St Patricks Day night, and any evening where a late-night special event takes place there will be 1 SIA registered door supervisor from 22:00hrs to 15 minutes after terminal hour and an additional SIA registered door supervisor from 23:30hrs to 15 minutes after terminal hour
14. SIA door staff will check ALL bags being brought into the premises
15. Posters no smaller than A4 size will be displayed stating that bag checks will be conducted when SIA door staff are present
16. SIA door staff will be equipped with a metal detector wand which will be used to make checks at the discretion of the SIA door staff and licence holder
17. Posters, no smaller than A4 size, clearly and prominently displayed stating the premises operates a zero drugs policy
18. Any individual found to be in possession of a small amount of drugs for personal use, a staff member will confiscate the items and advise the individual that they will not be returned to them
19. All drugs found or confiscated to be placed in the safe. A Drugs Record will be completed showing time and date that the drugs were seized / found along with the name of the person who seized / found the drugs. Management will liaise with Police to arrange for collection of said drugs. Officer(s) will sign the Drugs Record to confirm the drugs have been removed from the premises for destruction. For any drugs which appear to be in excess of those for personal use, Police must be contacted immediately.
20. Any incidents of fighting, disorder and/or weapons will be reported to the Police immediately
21. A log of all incidents stating date, time and description of the incident/offender kept and produced upon request by the Police or other relevant authority
22. There must be a mobile or landline telephone contact number working at all times the premises is open to the public
23. Challenge 25 scheme in operation
24. Challenge 25 posters clearly and prominently displayed
25. Driving licences and passports are the only accepted form of identification
26. Refusals log compiled and maintained
27. Refusals log to be produced upon request to the Police or other relevant authority
28. Persons under the age of 18 permitted on the premises from 10.00hrs to 20.00hrs.
29. Persons under the age of 18 permitted on the premises, if accompanied by a responsible person over the age of 18, from 20:00hrs to 22:00hrs.
30. No persons under the age of 18 permitted on the premises after 22.00hrs.
31. All staff trained on the sale of age restricted products, the challenge 25 policy, licence conditions and all local policies and procedures at the commencement of their employment and every 6 months thereafter
32. Records of this to be made and signed by staff to state they have received and understood the training
33. Training records to be made available upon request to the Police or other relevant authority
34. Premises to obtain Pubwatch Membership
35. Premises subscribed to Rochdale Town Centre Link Radio
Alcohol Deliveries - Proposed Licence Conditions: Between hours of 10:00am to 22:00hrs
1. Local delivery (deliveries made directly by Hoochi Koochi): A minimum of 4 hours between ordering and delivery for orders containing drinks only. For orders containing both food and drinks, last order time 2100 hours with a minimum £15 spent on food. All local deliveries completed by 2200 hours. Orders for courier delivery would be a minimum of next day delivery from ordering. This condition is subject to a 6 month trial period with a view to becoming permanent in the absence of any operational or consumer complaints.
2. For national/out of area courier deliveries, all alcohol items will be packaged and clearly labelled to show that the package contains age restricted items (e.g. over 18s only).
For local deliveries an experienced senior member of staff who is well versed in age restrictions to act as designated delivery from Hoochi Koochi.
3. In order to provide transparency and an audit trail, all alcohol products will be delivered to persons aged 18 or above and will be signed for. (Please see temporary condition 10, below for information in respect of absence of customer signature).
4. A "Challenge 25" process will be adopted on delivery, with age verification using Passport, Driving Licence or Proof of Age Scheme Card which carries the PASS Hologram.
5. The point of sale once an order is received and the subsequent dispatch address for food/alcohol will always be the premises as shown on the licence.
6. A record of all sales and deliveries will be kept, including ID verification procedures. In respect of Courier Services and upon request for information, this will be in line with the companies GDPR and data protection compliance policies. In respect of local sales and deliveries those records will be made available to Police or other relevant authority for inspection.
7. Both Courier and Local Deliveries aided by time constraints in condition 1 will be conducted in such a manner to avoid causing disturbance to nearby residents.
The below conditions are in force in line with the Health Protection (Coronavirus, Restrictions) (England) Regulations 2020 and will remain valid on the premises licence until Relaxation of Covid - 19 Legislation
8. No large alcohol deliveries will take place to any address which will break up to date/current Government Covid Legislation at the time the order is made.
9. There will be a minimum of 18 hours between alcohol deliveries at the same address.
10. In place of a signature, the name of the person accepting the delivery will be provided to the Courier (and must correspond with the ID - if shown); a record of this will be kept.
