  The following conditions apply unless they have been superseded by provisions of the Licensing Act 2003.

   

   

  Off Licence Conditions

   

  Embedded conditions

   

  Alcohol shall not be sold or supplied except during permitted hours. In this condition, permitted hours means:

   

  a. On weekdays, other than Christmas Day, 8 a.m. to 11 p.m.

  b. On Sundays, other than Christmas Day, 10 a.m. to 10.30 p.m.

  c.  On Christmas Day, 12 noon to 3 p.m. and 7 p.m. to 10.30 p.m.

  d. On Good Friday, 8 a.m. to 10.30 p.m.

   

  The above restrictions do not prohibit:

   

  (a) during the first twenty minutes after the above hours, the taking of the alcohol from the premises, unless the alcohol is supplied or taken in an open vessel;

  (b) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;

  (c) the sale of alcohol to a trader or club for the purposes of the trade or club;

  (d) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;

  Licensing Act 2003 Mandatory Conditions

   

  Mandatory conditions where licence authorises the supply of alcohol

   

   

  (1)              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

   

  From 1st October 2010 these conditions will also apply

   

  (3)              (a) The premises licence holder or club certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

                (b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

   

• ANNEX 2 - Conditions Consistent with the operating schedule

   

  1. A CCTV system is to be installed and maintained in the premises, such images to be made available to the Police on request for evidential purposes.

  2. Checkout / point of sale is manned at all times.

  3. All escape routes and exits (including external exits) will be kept unobstructed, in good order with non-slippery and even surfaces, free to trip hazards and clearly identified.

  4. All exit doors will be easily openable without the use of a key, card, code or similar means and such doors will be regularly checked to ensure that they function satisfactorily and any removable security fastenings will be removed whenever the premises are open to the public.

  5. Notices are displayed providing fire evacuation procedure.

  6. All age related products are supplied by authorised sale.

  7. A refusals book is operated at the point of sale (see further notes in Annex 3)

   

   

• ANNEX 3 - Conditions attached after a review hearing by the licensing authority

   

  1. To operate a Challenge 25 Policy, anyone who appears to be under 25 and who is attempting to buy alcohol must be required to provide "Proof of Age" and to ask for appropriate identification of proof of age with a photograph of the person displayed on the I.D

  2. All staff trained in basic Health and Safety at work and age related product sales in respect to training in relation to age restricted products:

   

  To ensure that staff receive training in respect to the law relating to the sale of age restricted products every three months

   

  To maintain a record of this training and be able to produce this record upon request to authorised officers of RMBC. The records of training to be signed by staff confirming that the training has been received and understood.

   

  3. To record any remedial action following a report from Trading Standards of an alleged underage sale from the premises. To produce a record of the remedial action taken, on request to an authorised officer.

  4. To attend training events and seminars organised by Trading Standards when required to do so.

  5. CCTV images to be retained for a minimum of 28 days and be made available to authorised officers upon request.

  6. The refusals register must be completed and maintained correctly

  7. Mr Imran Raja to receive new training in Challenge 25 as agreed
