  The following conditions apply unless they have been superseded by provisions of the Licensing Act 2003.

   

  Club premises certificate Conditions

   

  Embedded Conditions

   

  Alcohol shall not be sold or supplied except during permitted hours.

  In this condition, permitted hours means:

  a. On weekdays, other than Christmas Day, Good Friday or New Year’s Eve, 11 a.m. to 11 p.m.

  b. On Sundays, other than Christmas Day or New Year’s Eve, 12 noon to 10.30 p.m.

  c. On Good Friday, 12 noon to 10.30 p.m.

  d. On New Year’s Eve, except on a Sunday, 11 a.m. to 11 p.m.

  e. On New Year’s Eve on a Sunday, 12 noon to 10.30 p.m.

  f. On Christmas day, as provided by the rules of the club and notified in writing by the chairman or secretary of the club to the chief executive of the justices for the petty sessions area in which the premises are. The said hours shall:

  i.  not exceed six and a half hours;

  ii. not begin earlier than 12 noon;

  iii. not end later than 10.30 p.m.

  iv. provide for a break of at least 2 hours, including 3 p.m. to 5 p.m.;

  v. not extend for more than three and a half hours after 5 p.m.

  The above restrictions do not prohibit the supply to, or consumption by, any person of alcohol in any premises where they are residing.

  g. On New Year’s Eve from the end of permitted hours to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31st December).

   

  Credit Sales

  Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied:

  (a) with and for consumption at a meal supplied at the same time, consumed with the meal and paid for together with the meal;

   

  Certificate authorising supply of alcohol for consumption off the premises
   

  (1) A club premises certificate may not authorise the supply of alcohol for consumption off the premises unless it also authorises the supply of alcohol to a member of the club for consumption on those premises.
   

  (2) A club premises certificate which authorises the supply of alcohol for consumption off the premises must include the following conditions.
   

  (3) The first condition is that the supply must be made at a time when the premises are open for the purposes of supplying alcohol, in accordance with the club premises certificate, to members of the club for consumption on the premises.
   

  (4) The second condition is that any alcohol supplied for consumption off the premises must be in a sealed container.
   

        (5) The third condition is that any supply of alcohol for consumption off the

              premises must be made to a member of the club in person.

   

   

  Licensing Act 2003 Mandatory Conditions

   

  Mandatory conditions where licence authorises the supply of alcohol

   

   

  (1)              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

   

   

  Mandatory Condition where the licence permits the performance of Films

   

  Where a programme includes a film in the 12A, 15 or 18 category, as classified by the British board of Film Classification, no person appearing to be under the age of 12 (and unaccompanied in that case),15 or 18 as appropriate shall be admitted to any part of the programme; and the licence holder shall display in a conspicuous position a notice in the following terms-

   

  PERSONS UNDER THE AGE OF [INSERT APPROPRIATE AGE] CANNOT BE ADMITTED TO ANY PART OF THE PROGRAMME

   

  Where films of different categories form part of the same programme, the notice shall refer to the oldest age restriction.

   

  This condition does not apply to members of staff under the relevant age while on duty provided the prior written consent of the person’s parents or legal guardian has first been obtained.

   

  Immediately before each exhibition of a film passed by the British Board of Film Classification there shall be exhibited on screen for at least five seconds a in such a manner that it can be easily read by all persons in the auditorium a reproduction of the certificate of the Board or, as regards a trailer advertising a film, of the statement approved by the Board indicating the category of the film

   

  Mandatory conditions where Door Supervisors are provided

   

  All individuals who carry out security activities must be licensed by the Security Industry Authority (SIA)

   

  Mandatory Conditions for club Premises with off sales

   

  1) The supply of alcohol for consumption off the club premises must be made at a time when the premises are open for the purposes of supplying alcohol, in accordance with the club premises certificate, to members of the club for consumption on the premises.

   

  2) Any alcohol supplied for consumption off the premises must be in a sealed container.

   

  3) That any supply of alcohol for consumption off the premises must be made to a member of the club in person.

   

   

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  1. There is a computerised card entry system in place. Only members hold such cards.

  2. CCTV within the premises.

  3. Club constitution includes rules governing the conduct of members and their guests within and adjacent to the club premises.

  4. Admission to the club is confined to members, bona fide guests and pre-organised functions through a computerised door entry system.

  5. Guests arriving unaccompanied are scrutinised via CCTV before admission and signing in by the host member.

  6. Club employees are instructed not to admit or serve members and guests who behave in a drunk or disorderly fashion.

  7. Misconduct is reported to the committee to consider action under the club's disciplinary code.

  8. The club complies with Health and Safety and Fire precautions regulations.

  9. Following Risk Assessment, preventative and control measures are in place to ensure the safety of members, guests, employees and entertainers while on the premises.

  10. The club complies with advised capacity limits.

  11. Fire action notices are posted. Emergency escape routes are signposted.

  12. Signage is displayed near exits requesting members and guests respect the needs of local residents by quietly leaving the premises and car park.

  13. When live or recorded music is played all reasonable steps are taken to avoid disturbance to neighbouring properties.

  14. Persons under age 18 are only allowed in the club if accompanied e.g. children and grandchildren attending a club junior disco in the function room.

  15. The function room bar will be closed during junior disco / parties.

  16. Accompanied children and grandchildren of members may be admitted to the snooker room for tuition.

  17. Door control ensures that children seeking admission to the club for any purpose are accompanied by an adult member.

  18. Young adults applying for membership must satisfy the committee that they are over 18, if necessary by providing proof of age.

  19. Accompanied children and grandchildren of members and their guests may attend a private party in the function room.

  20. Committee members, the club steward and other members of staff are instructed in the offence provisions of the Licensing Act 2003 relating to alcohol and the protection of children.

  21. Signage is posted at all bars prohibiting the direct or indirect supply or delivery of alcohol to children.

• ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY

   

  1. Live entertainment shall stop at 23:30 hrs Sunday to Friday and 00:00 hrs on Saturday.

  2. The volume of recorded music will be reduced at 23:30 hrs Sunday to Friday and 00:00 hrs on Saturday.

  3. All windows and doors will be closed after 23:30 hrs. It should be noted in any event that the property has the benefit of double glazing and the front door is closed at all times due to the fact that there is a card entry system in place.
