  The following conditions apply unless they have been superseded by provisions of the Licensing Act 2003.

   

  Club premises certificate Conditions

   

  Embedded Conditions

   

  Alcohol shall not be sold or supplied except during permitted hours.

  In this condition, permitted hours means:

  a. On weekdays, other than Christmas Day, Good Friday or New Year’s Eve, 11 a.m. to 11 p.m.

  b. On Sundays, other than Christmas Day or New Year’s Eve, 12 noon to 10.30 p.m.

  c. On Good Friday, 12 noon to 10.30 p.m.

  d. On New Year’s Eve, except on a Sunday, 11 a.m. to 11 p.m.

  e. On New Year’s Eve on a Sunday, 12 noon to 10.30 p.m.

  f. On Christmas day, as provided by the rules of the club and notified in writing by the chairman or secretary of the club to the chief executive of the justices for the petty sessions area in which the premises are. The said hours shall:

  i.  not exceed six and a half hours;

  ii. not begin earlier than 12 noon;

  iii. not end later than 10.30 p.m.

  iv. provide for a break of at least 2 hours, including 3 p.m. to 5 p.m.;

  v. not extend for more than three and a half hours after 5 p.m.

  The above restrictions do not prohibit the supply to, or consumption by, any person of alcohol in any premises where they are residing.

  g. On New Year’s Eve from the end of permitted hours to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31st December).

   

  Credit Sales

  Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied:

  (a) with and for consumption at a meal supplied at the same time, consumed with the meal and paid for together with the meal;

   

  Certificate authorising supply of alcohol for consumption off the premises
   

  (1) A club premises certificate may not authorise the supply of alcohol for consumption off the premises unless it also authorises the supply of alcohol to a member of the club for consumption on those premises.
   

  (2) A club premises certificate which authorises the supply of alcohol for consumption off the premises must include the following conditions.
   

  (3) The first condition is that the supply must be made at a time when the premises are open for the purposes of supplying alcohol, in accordance with the club premises certificate, to members of the club for consumption on the premises.
   

  (4) The second condition is that any alcohol supplied for consumption off the premises must be in a sealed container.
   

        (5) The third condition is that any supply of alcohol for consumption off the

              premises must be made to a member of the club in person.

   

   

  Licensing Act 2003 Mandatory Conditions

   

  Mandatory conditions where licence authorises the supply of alcohol

   

   

  (1)              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

   

   

  Mandatory Condition where the licence permits the performance of Films

   

  Where a programme includes a film in the 12A, 15 or 18 category, as classified by the British board of Film Classification, no person appearing to be under the age of 12 (and unaccompanied in that case),15 or 18 as appropriate shall be admitted to any part of the programme; and the licence holder shall display in a conspicuous position a notice in the following terms-

   

  PERSONS UNDER THE AGE OF [INSERT APPROPRIATE AGE] CANNOT BE ADMITTED TO ANY PART OF THE PROGRAMME

   

  Where films of different categories form part of the same programme, the notice shall refer to the oldest age restriction.

   

  This condition does not apply to members of staff under the relevant age while on duty provided the prior written consent of the person’s parents or legal guardian has first been obtained.

   

  Immediately before each exhibition of a film passed by the British Board of Film Classification there shall be exhibited on screen for at least five seconds a in such a manner that it can be easily read by all persons in the auditorium a reproduction of the certificate of the Board or, as regards a trailer advertising a film, of the statement approved by the Board indicating the category of the film

   

  Mandatory conditions where Door Supervisors are provided

   

  All individuals who carry out security activities must be licensed by the Security Industry Authority (SIA)

   

  Mandatory Conditions for club Premises with off sales

   

  1) The supply of alcohol for consumption off the club premises must be made at a time when the premises are open for the purposes of supplying alcohol, in accordance with the club premises certificate, to members of the club for consumption on the premises.

   

  2) Any alcohol supplied for consumption off the premises must be in a sealed container.

   

  3) That any supply of alcohol for consumption off the premises must be made to a member of the club in person.

   

   

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  As per application form:

   

  1) Door entry is restricted by means of card control system and push button key pad.

  2) There is security lighting on the car park.

  3) All staff are instructed to remain vigilant and report any incidents to the secretary or if need be telephone the police.

  4) All fire exits and extinguishers are clearly marked.

  5) The fire alarm system is serviced and tested by FSEC Ltd, Middleton.

  6) Numbers attending functions are in compliance with recommendations made by G.M Fire Service.

  7) Sufficient staff are trained in First Aid and First Aid boxes are readily available.

  8) Fire drills are conducted on a monthly basis.

  9) Adequate signage is in place and conforms to current Health & Safety Law.

  10) Fire exits are checked regularly to ensure they are free from obstruction.

  11) No 18th or 21st Birthday parties are accepted.

  12) Access and egress is by way of private road and there is a large private parking area for those using vehicles.

  13) The premises are not open to the general public and the finishing time of functions is 11:30pm latest.

  140 Live artists and music reproduction noise levels are kept to a level which would not affect nearby residents.

  15) Juniors aged between 10-17 are not allowed in the clubhouse after dusk unless accompanied by an adult.

  16) They are not allowed to play the gaming machine.

  17) Our steward is instructed to ask for proof of age should he suspect a young person is attempting to buy alcohol.  This is done by requesting birth certificates, driving licences, passports or student accreditation.

  18) When interviewed for membership, all prospective junior members (10-17) are told they must not attempt to purchase alcohol; this warning also appears in the junior rules issued on becoming a member.
