  The following conditions apply unless they have been superseded by provisions of the Licensing Act 2003.

  Licensing Act 2003 Mandatory Conditions

   

  Mandatory conditions where licence authorises the supply of alcohol

   

   

  (1)              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

  Conditions Consistent with the operating schedule

   

  1. A tamper proof CCTV system shall be installed at the premises and shall function fully during all hours that a licesnable activity takes place on the premises.

  2. Record images to show customers entering the store, to show customers at the alcohol displays and to provide clear uninterrupted facial images of customers at the point(s) of sale.

  3. Signage on entry to the store clearly stating CCTV in operation.

  4. CCTV equipment must be maintained in good working order in accordance with manufacturers instructions. If the Premises Licence Holder/DPS is aware that the CCTV is not working, no alcohol may be sold until such time that it is fully operational. Regular checks of the CCTV system will be made and documented.

  5. The images recorded by the CCTV system shall be retained in unedited form for a period of not less than 31 days and images to be produced to the Police and Authorised Officers of RMBC upon request.

  6. Ensure all staff comply with Challenge 25 policy.

  7. Document refusals/challenges; these documented incidents to be made available to the responsible body upon request.

  8. Clear signage at the store to inform customers that Challenge 25 policy operates at the store.

  9. Fully train staff in relation to the sale of alcohol, age restricted products, Challenge 25 and the prevention of proxy sales. Quarterly documented knowledge checks to be implemented.

  10. To ask for appropriate identification of proof of age with a photograph of the person displated on the I.D.

  11. To provide training, at least once a year, to new and existing staff, on the law relating to underage sales of alcohol.

  12. To keep written records of all training provided in respect to the law relating to underage sales of alcohol. Staff to sign and date records to confirm that the training has been received and understood.

  13. The DPS and Premises Licence Holder shall prevent their business causing any nuisance to any local residents or businesses. They will monitor the external premises area in relation to any anti-social behaviour or public nuisance.

  14. The premises will only accept trade deliveries or rubbish collections during normal working hours.

  15. The DPS will also monitor the exterior of the premises to ensure litter is kept to a minimum.
