  The following conditions apply unless they have been superseded by provisions of the Licensing Act 2003.

   

   

  Off Licence Conditions

   

  Embedded conditions

   

  Alcohol shall not be sold or supplied except during permitted hours. In this condition, permitted hours means:

   

  a. On weekdays, other than Christmas Day, 8 a.m. to 11 p.m.

  b. On Sundays, other than Christmas Day, 10 a.m. to 10.30 p.m.

  c.  On Christmas Day, 12 noon to 3 p.m. and 7 p.m. to 10.30 p.m.

  d. On Good Friday, 8 a.m. to 10.30 p.m.

   

  The above restrictions do not prohibit:

   

  (a) during the first twenty minutes after the above hours, the taking of the alcohol from the premises, unless the alcohol is supplied or taken in an open vessel;

  (b) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;

  (c) the sale of alcohol to a trader or club for the purposes of the trade or club;

  (d) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;

   

   

  Licensing Act 2003 Mandatory Conditions

   

  Mandatory conditions where licence authorises the supply of alcohol

   

   

  (1)              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

   

  From 1st October 2010 these conditions will also apply

   

  (4)              (a) The premises licence holder or club certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

                (b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

  (5)              The responsible person shall ensure that -

                (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -

                (i) beer or cider: ½ pint;

                (ii) gin, rum, vodka or whiskey: 25ml or 35ml; and

                (iii) still wine in a glass: 125ml: and

                (b) customers are made aware of the availability of these measures

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

   

  1. CCTV images to be retained for 28 days and produced to Authorised Officers of RMBC immediately upon request.

   

  2. The Licensee/The Manager/Duty Manager will be able to produce the required CCTV images immediately upon request to Authorised Officers of RMBC.

   

  3. CCTV equipment to be checked at the commencement of the trading day. If the CCTV is not working no sale of alcohol may take place until such times as the equipment is working.

   

  4. A refusal log is to be kept to record dates and times of all refusals to retail alcohol to underage persons.

   

  5. A copy of the Refusals log will be made available immediately upon request of Authorised Officers of RMBC.

   

  6. Challenge 21 scheme operated at premises.

   

  7. Challenge 21 posters to be clearly and prominently displayed.

   

  8. To ask for appropriate identification of proof of age with a photograph of the person displayed on the I.D.

   

  9. To provide training, at least once a year, to existing staff, on the law relating to underage sales of alcohol.

   

  10. To provide training for all new staff on the sale of age restricted products.

   

  11. To attend training seminars organised by the Trading Standards Service as and when requested to do so.

   

  12. To inform all staff of changes in the law relating to age-restricted products as and when required.

   

  13. To keep written records of all training provided in respect to the law relating to underage sales of alcohol. Staff to sign and date records to confirm that the training has been received and understood.

   

  14. To notify staff of any reports  of alleged underage sale incidents that has been brought to your attention by Trading Standards.

   

  15. To keep a log of such notifications on file, ready for inspection by authorised officers of RMBC if required.

   

  16. To record any remedial action following a report from Trading Standards of an alleged underage sale from the premise.

   

  17. To produce a copy of the 'Record of Remedial Action' if requested by an authorised officer of RMBC.

   

  18. Premises will alert police if anything goes wrong at the premises.

   

  19. Staff will request ID whenever needed.

   

  20. Premises has got CCTV installed and operational 24 hours.

   

  21. No adult entertainment at premises.
