  The following conditions apply unless they have been superseded by provisions of the Licensing Act 2003.

   

  EMBEDDED CONDITIONS:

   

  S.164 LA 1964 Off licence  - Alcohol shall not be sold in an open container or consumed in the licensed premises.

   

  Off Licences and Off Sales departments of on licensed premises.

   

  The above restrictions do not prohibit:

   

  (a) During the first twenty minutes after the above hours, the taking of the alcohol from the premises, unless the alcohol is supplied or taken in an open vessel.

   

  (b) The ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.

   

  (c) The sale of alcohol to a trader or club for the purposes of the trade or club.

   

  (d) The sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the Authority of The Secretary of State or an Authorised Mess of Members of Her Majesty's Naval, Military or Air Forces.

   

  S.166 LA 1964 Licensed Premises  

   

  Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied

   

  (a) With and for consumption at a meal supplied at the same time, consumed with the meal and paid for together with the meal.

   

  (b) For consumption by a person residing in the premises or his guest and paid for together with his accommodation.

   

  (c) To a canteen or mess.   

   

   

  Off Licence

   

   

  Licensing Act 2003 Mandatory Conditions

   

  Mandatory conditions where licence authorises the supply of alcohol

   

   

  (1)              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

   

  From 1st October 2010 these conditions will also apply

   

  (3)              (a) The premises licence holder or club certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

                (b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  1. CCTV multiplex system covering the site internally and externally supported by 31-day recording facilities.

  2. Check out /point of sale is manned at all times.

  3. Full alarm system.

  4. Shunt locks and night pay hatch facilities.

  5. The doors will be locked from 23:00hrs until 05:00hrs with service via the night pay hatch.

  6. All health and safety provisions will be satisfied together with statutory fire regulations.

  7. All fire doors will be maintained effectively self-closing and shall not be held open.

  8. Notices will be displayed providing fire evacuation procedure.

  9. All staff trained in basic health and safety at work and age related product sales.

  10. Litterbins will be provided and site wil be cleaned daily as part of cleaner’s duties.

  11. All age related products are supplied by supervised sale

  12. ID will be required under challenge 21 procedure

  13. A refusals book is operated at the point of sale

   

   

• ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY

   

  1. The premises entrance is closed to the public after 11pm until 5am

   

  Following condition removed as per Minor Variation Application granted on 29th April 2013;

   

                       The Designated Premises Supervisor be re-trained within the next 28 days with regards to their responsibilities and the conditions of the Premises Licence and that a record is kept of this

                        Two additional staff are employed between the hours of 23:00 - 05:00 to assist the cashier in obtaining goods from the shop floor for service through the hatch
