ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. A tamper proof CCTV system shall be installed at the premises and shall function fully during all hours that a licensable activity takes place on the premises.
2. Recorded images to show customers entering the store, to show customers at the alcohol displays and to provide clear uninterrupted facial images of customers at the point of sale.
3. Signage on entry to the store clearly stating CCTV in operation.
4. Where CCTV equipment is fitted, it shall be maintained in good working order in accordance with manufacturer’s instructions.
5. Congregation of Youths in the vicinity of the premises is to be discouraged at all times the premises is open.
6. CCTV images to be retained for 28 days and produced to authorised officers of RMBC immediately upon request.
7. The Licensee/Manager/Duty Manager will be able to produce the required CCTV images immediately upon request to authorised officers of RMBC.
8. A refusal log is to be kept to record dates and times of all refusals to retail alcohol to underage persons.
9. A copy of the refusals log will be made available immediately upon request of authorised officers of RMBC.
10. Any incidents of crime and disorder at or immediately outside the premises, witnessed by staff, will be recorded in an incident book kept at the premises. This book will be kept in the shop and available for inspection.
11. Spirits will be kept behind the counter.
12. To ask for appropriate identification of proof of age with a photograph of the person displayed on the I.D.
Record this request on an "I.D. Request Log".
13. The premises shall operate an alcohol refusals policy - alcohol will not be sold to;
(1) Any person recognised or identified as a street drinker (regardless of their level of inebriation at the time);
(2) Any person found to be drinking alcohol in the street;
(3) Any person who is drunk or appears to be drunk;
(4) Any person suspected of trying to buy alcohol for another person who is drunk or appears to be drunk;
(5) Any person unable to provide valid ID when requested by staff;
(6) Any person who is verbally or physically abusive towards staff or customers.
(7) To any person suspected of trying to buy alcohol for another person(s) who may be under age.
A notice advising customers of the refusals policy shall be on display.
14. To inform all staff of changes in the law relating to age restricted products as and when required.
15. Deliveries to the premises will be arranged to avoid any public nuisance.
16. Staff will monitor the area immediately outside the premises on a regular basis to check for, and to properly dispose of, any litter from the premises.
17. To keep written records of all training provided in respect to the law relating underage sales of alcohol. Staff to sign and date records to confirm that the training has been received and understood.
18. To notify staff of any reports of alleged underage sale incidents that has been brought to your attention by Trading Standards.
19. To keep a log of such notifications on file, ready for inspection by authorised officers of RMBC if required.
20. To record any remedial action following a report from Trading Standards of an alleged underage sale from the premise.
21. To produce a copy of the "Record of Remedial Action" if requested by an authorised officer of RMBC.
22. A notice shall be displayed in the premises where it can be seen clearly to advise customers that it is unlawful for persons under 18 to purchase alcohol or for any persons to purchase alcohol on behalf of a person under 18 years of age.
