  The following conditions apply unless they have been superseded by provisions of the Licensing Act 2003.

   

   

  Off Licence Conditions

   

  Embedded conditions

   

  Alcohol shall not be sold or supplied except during permitted hours. In this condition, permitted hours means:

   

  a. On weekdays, other than Christmas Day, 8 a.m. to 11 p.m.

  b. On Sundays, other than Christmas Day, 10 a.m. to 10.30 p.m.

  c.  On Christmas Day, 12 noon to 3 p.m. and 7 p.m. to 10.30 p.m.

  d. On Good Friday, 8 a.m. to 10.30 p.m.

   

  The above restrictions do not prohibit:

   

  (a) during the first twenty minutes after the above hours, the taking of the alcohol from the premises, unless the alcohol is supplied or taken in an open vessel;

  (b) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;

  (c) the sale of alcohol to a trader or club for the purposes of the trade or club;

  (d) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;

   

   

  Licensing Act 2003 Mandatory Conditions

   

  Mandatory conditions where licence authorises the supply of alcohol

   

   

  (1)              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

• ANNEX 2 - Conditions Consistent with the operating schedule

   

  1. CCTV installed and fully operational with 24 hour recording in use.

  2. Regular risk assessments carried out.

  3. Close liaison with local police.

  4. Proof of Age Scheme in operation.

  5. Prevent those adults who buy and then supply alcohol to children.

   

   

   

   

   

• ANNEX 3 - Conditions attached after a hearing by the licensing authority

  1. The Challenge 25 scheme is to be operated at these premises.

  2. Challenge 25 posters to be clearly and prominently displayed.

  3. To ask for appropriate identification of proof of age with a photograph of the person displayed on the I.D.

  4. A Refusal Log is to be kept to record dates and times of all refusals to retail alcohol to underage persons.

  5. A copy of the Refusals Log will be made available immediately upon request of Authorised Officers of Rochdale MBC.

  6. To provide training every six months to new and existing staff on the law relating to underage sales of alcohol.

  7. To keep written records of all training provided in respect of the law relating to underage sales of alcohol.  Staff to sign and date records to confirm that the training has been received and understood.

  8. To record any remedial action following a report from Trading Standards of an alleged underage sale from the premises.

  9. To produce a copy of the 'Record of Remedial Action' if requested by authorised Officer of Rochdale MBC.

  10. All staff be trained fully regarding the procedure concerning underage sales within the next 28 days and that they do not conduct any sale of alcohol until this takes place.
